Introduction

Fangate (“the Platform”) responds promptly to valid notices of alleged infringement that meet the requirements of the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. Possible remedies include removing or disabling access to the allegedly infringing material and, where appropriate, suspending or terminating the uploader’s account.

How to file a DMCA Notice of Copyright Infringement

If you are the copyright owner (or authorised agent) and believe that content on Fangate infringes your work, send a written notice that includes all elements required by 17 U.S.C. § 512(c)(3)

  1. Identification of the copyrighted work(s) claimed to be infringed, or a representative list.
  2. The exact URL(s) or other precise location of the material you believe is infringing.
  3. Sufficient contact information (name, postal address, telephone number and e‑mail).
  4. A statement of good‑faith belief that the disputed use is not authorised by the copyright owner, its agent or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner (or authorised agent) of the exclusive right allegedly infringed.
  6. Your physical or electronic signature (typing your full legal name is acceptable).

Important: Misrepresentations may expose you to liability for damages, including costs and attorneys’ fees, under 17 U.S.C. § 512(f).

What happens next

  • We will acknowledge receipt, review the notice for completeness, and—if compliant—remove or disable the specified content.
  • We will notify the affected uploader, who may submit a counter‑notification (see below).
  • We will maintain a record of all notices and actions taken.

Counter‑Notification Procedures

If you believe material you uploaded was removed by mistake or misidentification, you may submit a counter‑notice to the Designated Agent that includes:

  1. Your name, address, telephone number and electronic signature.
  2. Identification of the material that was removed or to which access was disabled, and its location before removal.
  3. A statement under penalty of perjury that you have a good‑faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. A statement consenting to the jurisdiction of the Federal District Court for the judicial district of your address (or, if outside the U.S., for any district in which Fangate may be found) and agreeing to accept service of process from the original complainant.

After receiving a valid counter‑notice we will forward it to the complainant and may restore the content 10‑14 business days later unless the complainant notifies us that they have filed court action to restrain you.

Repeat infringers

In accordance with the DMCA and our Terms of Service, Fangate terminates or disables accounts of users who are repeat infringers at our sole discretion.

Preventive measures

  • Verified‑only uploads: All creators must pass a Veriff OÜ age/identity check before they can upload, ensuring every uploader is 18+ and reachable. During the upload, the creator must affirm that they own—or have legally obtained—all copyrights and rights of use for the specific file being uploaded. Without this confirmation, the upload cannot proceed.
  • Automatic & manual review: We employ automated hash‑matching and manual moderation to block known infringing or prohibited content at upload.
  • Policy Updates

    This policy is effective as of 07-10-2025 and subject to periodic updates.
